Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the ZeroSMS messaging platform, websites and APIs (together, the “Service”) operated at zerosms.net. By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service.

1. Your account

You must provide accurate registration details and keep them up to date. You are responsible for all activity under your account and for keeping your credentials secure. You must be at least 18 years old and authorised to enter into these Terms on behalf of any organisation you represent.

2. Use of the Service

We grant you a non-exclusive, non-transferable right to use the Service to send application-to-person (A2P) SMS and related messaging to recipients who have given you valid consent. You agree to use the Service only for lawful purposes and in accordance with our Acceptable Use Policy, which forms part of these Terms.

3. Credits, pricing and payment

• The Service is prepaid: you add funds to your wallet and messages are charged against your balance at the per-destination price shown before you send.
• Prices are published in your dashboard and may change; the price applied is the one in effect at the time a message is accepted.
• Top-ups are processed through our payment partners. Added funds are non-refundable except where required by law; consumed credits are non-refundable.
• Messages that fail or are rejected before dispatch are refunded to your wallet where our platform is configured to do so.

4. Sender IDs and compliance

You are solely responsible for the sender IDs, content and recipients of your messages, and for complying with all applicable laws, carrier rules and country-specific sender registration requirements. Some destinations restrict alphanumeric sender IDs or require numeric formats; we route according to the rules configured for each destination.

5. Prohibited use

You must not use the Service to send unlawful, fraudulent, deceptive, harassing or unsolicited messages, or in any way that violates our Acceptable Use Policy. We may suspend or terminate accounts, block traffic and withhold delivery where we reasonably believe this Policy has been breached.

6. Service availability

We work to keep the Service available and messages flowing, but we do not guarantee uninterrupted or error-free operation. Delivery depends on mobile operators and third-party networks outside our control, and handset delivery is never guaranteed.

7. Suspension and termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, create risk or legal exposure for us, or fail to pay amounts due. On termination, unused prepaid balance may be refundable at our discretion and subject to applicable law.

8. Disclaimers and limitation of liability

The Service is provided “as is” without warranties of any kind, to the fullest extent permitted by law. To the maximum extent permitted by law, our aggregate liability arising out of or relating to the Service will not exceed the amount you paid to us in the three months preceding the event giving rise to the claim. We are not liable for indirect, incidental or consequential damages, or for messages not delivered by downstream networks.

9. Indemnification

You agree to indemnify and hold ZeroSMS harmless from claims, losses and expenses arising from your use of the Service, your content, or your breach of these Terms or applicable law.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified through the Service or by email. Continued use after changes take effect constitutes acceptance of the revised Terms.
